Thabo Bester’s Desperate Bid to Leave 'Hell' Prison Denied – Why the Facebook Rapist is Stuck in KZN!

In a legal blow that reverberated across South Africa, convicted murderer and rapist Thabo Bester, infamously dubbed the ‘Facebook Rapist’, has had his urgent application to be transferred from the maximum-security eBongweni Correctional Centre in KwaZulu-Natal (KZN) back to a facility in Gauteng emphatically denied by the High Court.

This ruling ensures that Bester, whose audacious escape from the Mangaung Correctional Centre last year captivated and appalled the nation, will remain incarcerated in the highly secure KZN facility, significantly complicating his legal team’s efforts to prepare for his upcoming trial.

Bester’s legal representatives had argued that his continued detention at eBongweni, a facility renowned for its stringent security measures and remote location, presented insurmountable logistical challenges for them to consult adequately with their client.
They contended that the distance and the restrictive nature of the prison environment were impeding their ability to prepare a robust defence, thereby infringing upon Bester’s constitutional right to a fair trial. The facility is equipped with state-of-the-art surveillance, strict movement controls, and a highly trained staff complement, making it one of the most secure prisons in the country.
The High Court’s decision underscores the judiciary’s commitment to ensuring that Bester, a high-profile and high-risk inmate, remains in an environment where the chances of another escape are minimised.
The logistical challenges cited by Bester’s legal team are indeed considerable. KZN is a significant distance from Gauteng, where many of the legal proceedings and preparatory work for his trial are based.
This necessitates extensive travel for his legal representatives, adding to the cost and complexity of his defence. However, the court likely weighed these concerns against the paramount public interest in ensuring Bester’s secure detention and preventing any further disruptions to the justice system.
