Durban Businessman Opens Fraud and Defamation Case Against Crime Intelligence Boss

Pretoria – Durban businessman Stuart James Scharnick, who was previously linked to suspended Deputy Police Commissioner Lieutenant-General Shadrack Sibiya during the Madlanga Commission, has taken legal action against Crime Intelligence boss, Lieutenant-General Dumisani Khumalo. Scharnick has opened a case of fraud and defamation of character following Khumalo's testimony before the Madlanga Commission of Inquiry.

Scharnick lodged the case at the Pretoria Central police station on Wednesday, asserting that Khumalo's testimony had caused significant damage to his reputation and endangered his life.

During his testimony at the Madlanga Commission, Khumalo extensively implicated Scharnick, alleging that the businessman had a history of 34 criminal cases, 18 convictions, and a series of withdrawn cases. Khumalo also labelled Scharnick a “hijacker”.

Speaking shortly after opening the case, Scharnick vehemently denied the allegations and vowed to fight the matter "tooth and nail."

“His testimony has caused irreparable damage to myself, my family and business, leaving our lives in danger because of mere association and speculation linking me to cartels and that I am a serial hijacker. I have never been convicted of hijacking,” he said.

The case promises to be a complex and closely watched legal battle, given the high-profile individuals involved and the serious nature of the allegations. The Madlanga Commission, where Khumalo's testimony was given, is investigating serious matters within the police force, adding another layer of complexity to the situation.
