Black Coffee in High Court Battle to Silence Nota Baloyi Over Explosive Social Media Claims
World-renowned DJ and producer Nkosinathi “Black Coffee” Maphumulo has launched an urgent high court bid to silence controversial music executive Nhlamulo “Nota” Baloyi following a series of explosive social media posts. The posts in question accuse the Grammy-winning DJ of associating with criminals, abuse, and shady financial dealings.
Black Coffee, who recently revealed in his divorce case that he is worth more than R1-billion, is seeking a court order to force Baloyi to immediately delete all the posts. Furthermore, he is demanding that Baloyi publish a full public apology worded exactly as he dictates, and that the court declare the statements false and defamatory.
According to the court papers, Black Coffee also intends to make Baloyi pay the legal costs on the harshest possible scale. The court documents reveal that Black Coffee initially attempted to obtain an emergency order without notifying Baloyi, an "ex parte" application. Having been unsuccessful, he has now returned with a second urgent application.
Baloyi, in his responding papers, accuses Black Coffee of leveraging his wealth and fame to bully and intimidate ordinary people who dare to criticise him. He argues that the application is not about defamation, but rather an attempt to stifle public discourse on issues that affect society.
Baloyi insists that everything he posted is either true or fair comment and is protected by the constitutional right to freedom of expression. He also accuses Black Coffee of harassing his mother by contacting her directly in an attempt to pressure him, conduct that Baloyi deems intimidatory.
In a bold counterattack, Baloyi is asking the court to dismiss Black Coffee’s case and order the DJ to pay punitive legal costs. He is also seeking an order for Black Coffee to pay R25,000 as compensation for the distress caused to Baloyi’s mother. Additionally, he wants the court to ban Black Coffee and his team from contacting Baloyi or his family except through official court channels.
Baloyi is requesting a postponement of the matter so that Black Coffee can first hand over certain documents he believes will substantiate his allegations. In the court papers, Baloyi points out that Black Coffee waited weeks before bringing the urgent application, despite the posts having been online for some time. He argues that this delay demonstrates a lack of genuine urgency and suggests that Black Coffee is attempting to harass and bankrupt him.
