Alexandra, South Africa – The Alexandra High Court has once again postponed the case of Bellarmine Mugabe and Tobias Mugabe Matondze, marking another setback in the legal proceedings. The decision, made on Tuesday morning, comes as the defence and the State remain deadlocked in plea negotiations.
The two men face a string of serious charges, including contravening the Immigration Act, attempted murder, defeating the ends of justice, and the illegal possession of a firearm. The case has been fraught with complications, further compounded by the pair's decision to abandon their bail application. This move followed revelations suggesting they may be in South Africa illegally, adding another layer to the already complex legal battle.
The repeated delays have raised questions about the progress of the case and the ability of both sides to reach a resolution. Defence lawyer Sinenhlanhla Mnguni expressed his frustration with the situation, stating: "I just think we haven’t found each other as much as we would have liked at this point. I know you said another postponement, but you would have noted from the words of the magistrate that they have marked this as a final postponement, for the parties to finalise their negotiations but also for the State to finalise their negotiations. We always conducted ourselves in good faith."
The magistrate has indicated that this postponement is the final one, urging both the defence and the State to use this time to conclude their negotiations and for the State to finalise its investigations. The future of the case now hinges on whether an agreement can be reached or if the matter will proceed to trial.
