The timing of the appointment, coinciding with the retirement of current NDPP Advocate Shamila Batohi, has raised eyebrows, especially since Mothibi's selection bypassed standard transparency protocols, including public interviews conducted by a panel led by Justice Minister Mmamoloko Kubayi.
Mothibi's prior role in unearthing corruption at Tembisa Hospital, where he identified Maumela as a key figure in syndicates that siphoned over two billion rand, adds complexity to the situation. The investigation was triggered by the courageous actions of whistle-blower Babita Deokaran, whose assassination in August 2021 highlighted the dangers of exposing corruption.
Political analysts like Professor Andre Duvenhage express scepticism about Mothibi's ability to act impartially against Maumela, given his appointment by the President. Duvenhage suggests that Mothibi's actions could be influenced by senior politicians within the African National Congress (ANC), including Ramaphosa himself, potentially undermining the Constitution.
Analyst Zakhele Ndlovu emphasizes that the pressure is on Mothibi to fast-track the prosecution against Maumela to avoid the perception of favouritism. The SIU's investigation revealed that Maumela allegedly utilized a network of forty-one companies to siphon off eight hundred and twenty million rand from Tembisa Hospital, leading to a raid on his home in JOHANNESBURG, where assets worth over one hundred and thirty-three million rand were seized.
The President himself faces legal scrutiny regarding the Phala Phala farm scandal, further complicating Mothibi's appointment. Professor Ntsikelelo Breakfast argues that Ramaphosa's lack of transparency suggests the appointment was politically motivated rather than in the interest of justice.

The controversy is deepened by the rejection of competent candidates like Advocate Nicolette Bell, Advocate Adrian Mopp, Andrea Johnson, Hermione Cronje, Advocate Xolisile Khanyile, and Advocate Menzi Simelane, leading to speculation that the outcome was predetermined to install Mothibi.
Ramaphosa's attempts to distance himself from Maumela have been met with scepticism, particularly regarding his account of a casual encounter in Sandhurst. The Democratic Alliance, led by Advocate Glynnis Breytenbach, accuses Ramaphosa of protecting his nephew and halting further probes into Maumela's operations.
As Mothibi assumes his new role, he inherits significant challenges, including delays in prosecuting high-profile state capture cases. While his track record at the SIU demonstrates his capability to move cases forward, the question remains whether his commitment to justice will extend to the President's inner circle.
